[Motivation]
혹시 영화에서 "귀하는 묵비권을 행사할수 있으며 변호사를 고용할수 있다" 라는 phrase를 들어봤는가?

영화에서 자주나오는 phrase 이다.
이것을 "Miranda Warning " 또는 "Miranda rights" 라 한다

[Korean Definition]
미란다 원칙 :  경찰관이 범인을 잡을 때 반드시 해야 하는 이 말을 바로 '미란다 경고'라 한다. 즉 누구든지 체포 또는 구속의 이유와 변호인의 조력을 받을 권리가 있음을 고지받지 아니하고는 체포 또는 구속을 당하지 아니한다.

[Origin] 미란다 원칙(Miranda warning)유래 :
  1. 1960년대초 아리조나주에서 Ernesto Miranda가 납치& 강간혐의로 잡힘. 
  2. 변호사도 선임되지 않은채 2명의 경찰에게 조사받음. 
  3. 2시간가량 심문과정동안 범행인정. 진술서도 씀
  4. 하지만 재판 시작되자마자 진술서를 증거로 인정하는것에 대해 이의 제기.
  5. 결국 연방대법원까지 가서  진술거부권, 변호인선임권 등의 권리를 고지 못받은것에 대해 따짐. 구두 자백과 범행자백 진술서는 위법하게 수집된 증거라고 따짐.
  6. 결국 무죄선고 받음.
  7. 그 후 미란다 사건은 이론으로 발전하여  미란다 원칙(Miranda warning)이 되었고 많은 나라에서 피의자를 체포 연행할 때 경찰은 그 이유와 진술거부권 변호인 선임권 등을 고지하고 체포함
